Public offer

1.1. This public offer (the “Offer”) sets out the terms of use of the PhukeTours24 service (the “Service”), owned by EmpireX Group Co, Ltd, 190/64 Pracha Uthit 1 Road, Moo 5, Ratsada Subdistrict, Mueang Phuket, Phuket Province, Thailand (the “Provider”).

1.2. The Service is an information platform that lets users review offers from verified partners (tour operators, yacht owners, guides) and send a request to book travel services (excursions, water transport rental, etc.) in Phuket, Thailand.

1.3. The Provider does not itself provide the travel services. All services are provided by independent partners, who bear full responsibility for their quality, safety and conformity with the description.

1.4. This Offer is accepted when the user sends a booking request through phuket-tours24.com, WhatsApp, Telegram or another agreed channel.

2.1. The Provider undertakes to:

— give the user up-to-date information about the partners’ services;

— pass the booking request for the chosen service on to the partner;

— assist the user until the booking is confirmed.

2.2. The Provider does not guarantee the partner’s availability and is not liable for the partners’ actions or omissions, including cancellation, a change of terms or poor service quality.

2.3. The actual contract for the travel service is concluded directly between the user and the partner after the booking is confirmed.

3.1. The user undertakes to:

— provide accurate contact details;

— read the terms of the specific service (including the partner’s cancellation policy);

— follow the rules of conduct set by the partner and by the laws of the Kingdom of Thailand.

3.2. The Provider undertakes to:

— keep personal data confidential;

— make reasonable efforts to pass the request on to the partner promptly;

— keep the user informed of the booking status.

4.1. Travel services are paid for directly to the partner — in cash, by bank transfer or by another agreed method — after the booking is confirmed.

4.2. The Provider charges the user no commission and takes no part in the financial settlement unless stated otherwise.

4.3. Refunds are made by the partner in accordance with its cancellation policy. The Provider assists in the refund process but does not guarantee its outcome.

5.1. The Provider is not liable for:

— inaccurate information provided by a partner;

— force majeure (natural disasters, bans by the Thai authorities, epidemics);

— the user’s personal risks while the service is provided (injuries, loss of property, etc.).

5.2. The Provider’s maximum liability is limited to 100% of the cost of the information and consulting services, if they were provided for a separate fee.

6.1. The Provider reserves the right to amend this Offer. The new version takes effect when it is published on the website.

6.2. All disputes are settled by negotiation. If no agreement is reached, the dispute is resolved under the laws of the Kingdom of Thailand.

6.3. This Offer is governed by the principles of good faith, reasonableness and fairness.
